Part 396:  Inspection, Repair & Maintenance

It is the motor carrier's responsibility to keep their commercial vehicles in safe and proper operating condition at all times.  The carrier must keep accurate records of vehicles and the inspections performed, repairs and maintenance.  If any vehicle is deemed to be unsafe to operate, the carrier shall not require any driver to operate it, but shall mark it "out-of-service."  Vehicles must undergo a major inspection at least once a year.

Drivers must complete a pre-trip and a post-trip inspection of their vehicle for every run.  The driver is required to keep a written record of inspections done at the end of each day, listing any defects or deficiencies that would affect the safe operation of the vehicle.   Corrective actions should be taken before putting the vehicle in service if it is considered to be unsafe.

Pre-trip inspections are of the utmost importance, not only for the safety of the driver, but for the safety of the public as well. Identifying safety hazards before a trip will prevent unnecessary breakdowns or possibly even accidents. Pre-trip Inspections are also required by Federal and State laws.   Again drivers are subject to random roadside safety inspections to identify any violations of Motor Carrier Highway Safety Regulations.   Violations can result in immediate and on-the-spot rulings of "out-of-service" until the violation can be corrected.
